Water Authority of Delfland Public Private Partnership: Financial Close - 2003

Following the selection of the Delfluent Consortium as the Preferred Bidder, the Delfland Water Authority had to negotiate the Financial Close of a Public Private Partnership for a 30-year Design Build Finance & Operate contract between the Water Authority of Delfland and Delfluent consortium - for a water treatment plant in Harnaschpolder. Leverage was appointed to the negotiating team with finance as its priority and in this role contributed to the timely closing of the contract.

The Water Authority holds elections every 4 years and appoints new governors to the board. Hence the proposal from Leverage for an Executive Guide (15 pages) about the essentials of the Public Private Partnership (in total: 53 contracts & 25,000 pages) to introduce the new governors - within a couple of hours - to the rights and obligations of the Water Authority in the various situations described by the contract.

Gautrain Public Private Partnership: Executive Guide - 2007

The South African province of Gauteng was struggling with the day-to-day realities of the Public Private Partnership (PPP) for the design, construction, financing and operation of a rapid train connnection between Johannesburg, Pretoria and the international airport Oliver Thambo. Leverage, together with its South African partner, put forweard a proposal to develop an 'Executive Guide' as a concise summary of the 40,000 contractual pages of the Gautrain PPP. Summary intended for the different divisions of the project team, the members of the board and the responsible politicians.

Water Authority of Delfland Public Private Partnership: establishment of a Partnership Forum - 2008

The Water Authority felt the need to open a forum for open discussions with the private partner, and to synchronize areas of common interest. Leverage was asked to develop a formula which would achieve the objective but leave the DBFO-contract as the only governing document for the PPP. Delfluent was firmly of the opinion that the contract should be the principle document. Two iterative round of interviews enabled Leverage to come up with specific proposals, which were then documented and eventually signed as a Memorandum of Understanding. The proposals established a Partnership Forum - in addition to the Design Build Finance & Operate contract - for the exploration of new joint development opportunities.

Water Authority of Delfland Public Private Partnership: Best and Final Offer negotiations - 2002

The Water Authority had set up a separate professional team to manage the establishment of the Public Private Partnership in the form of a Design, Build, Finance and Operate contract. This team took a very independent position, almost outside the standing organisation. When the Best And Final Offer negotiations phase for the two last contenders began, the Water Authority Directors felt the need for a Trait d'Union between Delfland and the project team. Aim: to select the Preferred Bidder. Leverage was appointed and managed to develop a good working relationship with the project team while keeping the directors fully involved in the progress.

The Ministry of the Treasury in South Africa has a specialised Public Private Partnership (PPP) Unit, responsible for all the PPPs at provincial and national level. They acknowledged the need to efficiently introduce new governors in the public sector to the PPPs under their responsibility. Leverage put forward the proposal to develop Executive Guides for all existing and future PPPs in South Africa.

Public Private Partnership Kromhout: risk matrix - 2007

The private sector consortium of Heijmans participated in the competitive dialogue for the project to reconstruct the Kromhout barracks. The development of a risk matrix for a private consortium split between the construction and the operational activities was felt to be very important. Leverage was appointed to conduct the interviews to develop this matrix and to have it signed by both divisions.

Following the Financial Close, the contract needed to be implemented in the day-to-day activities so that the Water Authority could develop a brand new way of working. The newly appointed contract manager wanted some continuïty and asked Leverage to stay on as a part-time member of the team, to assist him in putting the right procedures and practices in place.
